I highly doubt the children's custody would be given to him, he isn't really father of the year material and doesn't have the means to care for his kids.

He was already in a relationship with Shar Jackson at the time when Britney seduced him. If I were the guy, I too would leave my current spouse for someone like Britney. She's rich and well, you can say pretty too. For all it's worth, I blame Britney Spears too for wreaking others' relationship. Now that she got what she wanted (the 2 boys) she dumped him.
